Giving up on our dreams is not easy. I am a neonatologist, and I often watch the parents of my patients wish for the impossible. They come to the NICU with their own stories, their own expectations, and their own values. They have had nine long months to imagine their perfect child and often struggle with learning to accept the hand they have been dealt and the child they really have.Neonatology and geriatrics have a lot in common. Both specialties treat (...) patients who cannot describe their symptoms. Both deal with family members who are serving as surrogate decision-makers. These family members often wrestle with end‐of‐life issues, and they share a tendency to sometimes base their decisions on emotions rather than on the best interests of the patients involved. Identifying ethically allowable options for infants with trisomy 18 has become more challenging as medical standards of practice shift, based on emerging scientific data and changing societal perceptions of disability. Lack of a stable professional standard of practice ought not prevent ethicists from facilitating a consensus; rather, these “unsettled cases” require an individualized, narrative approach that allows the values of the family and the particularities of each case to provide the necessary additional moral grounding.

Making recognition decisions often requires us to reference the contents of working memory, the information available for ongoing cognitive processing. As such, understanding how recognition decisions are made when based on the contents of working memory is of critical importance. In this work we examine whether recognition decisions based on the contents of visual working memory follow a continuous decision process of graded information about the correct choice or a discrete decision process reflecting only knowing and guessing. We find a (...) clear pattern in favor of a continuous latent strength model of visual working memory–based decision making, supporting the notion that visual recognition decision processes are impacted by the degree of matching between the contents of working memory and the choices given. Relation to relevant findings and the implications for human information processing more generally are discussed. (shrink)

The writings of Stanley Cavell and Jacques Derrida share many points of intersection. One of these is their mutual interest in Shakespeare’s Hamlet; another is their assessments of J.L. Austin’s philosophy, and his concept of performativity. In this paper, we demonstrate that Cavell’s and Derrida’s respective essays on Hamlet offer a surprising insight into their views on Austin’s notion of performativity. Since Hamlet abounds with oaths and promises, testimonies and bearing witness, what is surprising is not that these philosophers should (...) have identified this theme but rather how they respond to it. We show that Derrida’s writings on Hamlet repeatedly draw and depend on the idea of performativity, amounting to a rapprochement with Austin’s concept; and we also show that Cavell questions the effectiveness of performatives in the play, in ways that sometimes resemble Derrida’s invocation of spectrality in the play. Mental health among students is one of the major concerns amidst the pandemic. Employing a correlational design, this study investigates the relationship between emotional intelligence and mental health among 152 senior high school students. Based on the statistical analysis, the r coefficient of 0.82 indicates a high positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision to reject the null hypothesis. Hence, a significant relationship exists between emotional intelligence and mental health (...) among senior high school. Implications were discussed in the study. (shrink)

Tobacco mosaic virus has served as a model organism for pathbreaking work in plant pathology, virology, biochemistry and applied genetics for more than a century. We were intrigued by a photograph published in Phytopathology in 1934 showing that Tabasco pepper plants responded to TMV infection with localized necrotic lesions, followed by abscission of the inoculated leaves. This dramatic outcome of a biological response to infection observed by Francis O. Holmes, a virologist at the Rockefeller Institute for Medical Research, was used (...) to score plants for resistance to TMV infection. Our objective was to gain a better understanding of early to mid-twentieth century ideas of genetic resistance to viruses in crop plants. We investigated Holmes’ observation as a practical exercise in reworking an experiment, having been inspired by Pamela Smith’s innovative Making and Knowing Project. We had a great deal of difficulty replicating Holmes’ experiment, finding that biological materials and experimental customs change over time, in ways that ideas do not. Using complementary tools plus careful study and interpretation of the original text and figures, we were able to rework, yet only partially replicate, this experiment. Reading peer-reviewed manuscripts that cited Holmes’ 1934 report provided an additional level of insight into the interpretation and replication of this work in the decades that followed. From this, we touch on how experimental reworking can inform our strategies to address the reproducibility “crisis” in twenty-first century science. (shrink)

The candid and deeply moving autobiographical sketches provide enormous insight into the mind and feelings of this exciting, outspoken, always intellectually honest and emotionally sensitive man. nvited talk at the Philosophy Club April 14th at University of St Andrews in which I Outline three positions regarding the distinction between good (period) and good-for and I then discuss Richard Kraut’s recent attack on Good, period and my own approach to the distinction. Eventually, this discussion develioped into the book The Value Gap (OUP 2021).

Objective: Ethical guidelines are designed to ensure benefits, protection and respect of participants in clinical research. Clinical trials must now be registered on open-access databases and provide details on ethical considerations. This systematic survey aimed to determine the extent to which recently registered clinical trials report the use of standard of care and post-trial obligations in trial registries, and whether trial characteristics vary according to setting. Methods: We selected global randomized trials registered on http://www.clinicaltrials.gov and http://www.controlled-trials.com. We searched for intervention (...) trials of HIV/AIDS, malaria, and tuberculosis from 9 October 2004, the date of the most recent version of the Helsinki Declaration, to 10 April 2007. Results: We collected data from 312 trials. Fifty-eight percent (58%, 95% CI = 53 to 64) of trial protocols report informed consent. Fifty-eight percent (58%, 95% CI = 53 to 64) of trials report active controls. Almost no trials (1%, 95% CI = 0.5 to 3) mention post-trial provisions. Most trials measure surrogate outcomes. Twenty percent (20%, 95% CI = 16 to 25) of trials measure patient-important outcomes, such as death; and the odds that these outcomes are in a low income country are five times greater than for a developed country (odds ratio (OR) 5.03, 95% CI = 2.70 to 9.35, p = < 0.001). Pharmaceutical companies are involved in 28% (CI = 23 to 33) of trials and measure surrogate outcomes more often than nonpharmaceutical companies (OR 2.45, 95% CI = 1.18 to 5.09, p = 0.31). Conclusion: We found a large discrepancy in the quality of reporting and approaches used in trials in developing settings compared to wealthier settings. (shrink)

On April 26, 1995, the United States Supreme Court limited the reach of the preemption provision of ERISA in New York State Conference of Blue Cross & Blue Shield Plans v. Tavelers Insurance Co. ). In Travelers, the Supreme Court upheld the validity of a New York statute requiring hospitals to collect surcharges from patients covered by commercial insurers and requiring health maintenance organizations to pay a surcharge to the state's general fund that varies depending on the number of (...) Medicaid-eligible HMO members enrolled. Neither patients insured by Blue Cross/Blue Shield plans nor the plans themselves are similarly charged under the statute. Several commercial insurers and HMOs claimed the surcharges should be preempted under ERISA because they are levied on patients whose insurance or HMO membership premiums are purchased by an ERISA plan.The ERISA preemption clause means that federal regulation, or lack thereof, supersedes state regulation that is related to employee pension and benefit plans. This preemption clause prevents states from changing health care and benefit law for a significant portion of state residents. (shrink)

Yet it has only been of late years that due consideration has been given to this ancient Codex, which is the actual MS. corrected by Vettius Mavortius' own hand. Mr. Winstedt has spoken of the neglect which it has suffered for (...) the most part from editors, and also of the similar lack of attention paid even by Dressel to its seventh-century companion at Milan—the Codex Ambrosianus; while, later, J. Bergman shewed himself enthusiastic in its praise . Although the beliefs, preferences, and constraints (BPC) model may account for individuals independently making simple decisions, it becomes less useful the more complex the social setting and the decisions themselves become. Perhaps rather than seek to unify their field under one model, behavioral scientists could explore when and why the BPC model generally applies versus fails to apply as a null hypothesis. We support the ambitious goal of unification within the behavioral sciences. We suggest that Darwinian evolution by means of natural selection can provide the integrative glue for this purpose, and we review our own work on selective investment theory (SIT), which is an example of how other-regarding preferences can be accommodated by a gene-centered account of evolution. This period of doctoral study is the subject of Anderson’s interesting and eminently readable new book. Anderson enjoyably weaves together several different genres in his reflections on his experience with Barth, smoothly transitioning back and forth between personal memoir, constructive theological argument, and thoughtful interpretation of Barth’s life and writings.Structurally, the book offers a series of recollections and reflections gathered loosely around common themes rather than a tightly knit argument pursued rigorously from beginning to end. In other words, the work is a series of sketches from the artist’s notebook, as opposed to one intricate and detailed portrait focusing on a single subject. [End Page 207]In the first five chapters of the book, Anderson sketches a picture of the elderly Karl Barth who served as his “doktorvater,” drawing material from his student notes and personal memories of the years he spent with Barth in Basel. While Anderson finds continuity between the earlier and later writings of Barth, he suggests that the older Barth began to increasingly unfold the “fuller, grace-centered and human-shaped positive implications” of the earlier writings (viii). In Anderson’s experience, Barth’s early appeal to “Let God be God!” had in those later years “mellowed to an even deeper appeal to let God be himself, human as well, in the most unexpected ways” (11). This mellowing extended beyond Barth’s writing to his personality and demeanor as a teacher and theologian. While there has even been an outpouring of books and articles in English, many of these studies have been introductory and few reflect the careful detailed scholarship displayed by European scholars. In April, 1966, a group of some of the most distinguished Marx scholars from all over the world participated in a truly international symposium at Notre Dame. Although (...) the title is a misnomer because the papers range over much more than Marx and the Western world, the result is an impressive array of articles on many aspects of Marx's thought and influence. The most notable feature of this collection is the high seriousness of the discussions and the thorough scholarship they reflect. This article considers the implications of jus in bello for jus post bellum by exploring the relevant differences between victims of different sides in World War II: the Jewish Holocaust victims and the German civilians bombed by the Allied air forces. Some assert a moral equivalence between the catastrophes these two groups endured [Appleyard, Bryan. (2017). “I’m a Holocaust Sleuth.” The Weekend Australian Magazine, April 8–9: 27–28]. Although we do not dispute that German civilians suffered as victims of Allied (...) aerial bombings, we do question the depiction of their suffering as morally equivalent to the Holocaust of European Jewry. Much of the German war effort was directed at exterminating Jews. Likewise, much of the Allied war effort was directed at bombing German civilians. Both were wicked acts. But they embody very different goals, which were achieved by employing very different means. We present three factors that consider those different goals and means, thereby demonstrating that the Nazis’ victimisation of Jews was far worse than the Allies’ victimisation of German civilians. We conclude by urging military ethicists to learn from the past and to recognise that the treatment of the victims of war has implications for later generations. (shrink)

With a few incisive (and legitimate) criticisms of crucial experiments in psychology that purported to bring down the foundations of modern economics, together with a broad scholarly review that is praiseworthy, Gintis attempts to build a unifying framework for the behavioral sciences. His efforts fail, however, because he fails to break with the conventional methodology, which, regrettably, is the unifying basis of the behavioral sciences. As a result, his efforts will merely recapitulate the story of the past: interesting, provocative results (...) that are soon overthrown because they are limited to the conditions of the experiment. Gintis is keenly aware of this limitation – and thus meets Brunswik, but fails to recognize him; this we know because he seems unaware of the fact that Brunswik said it all – and provided a detailed defense – a half century ago. The primary objective was to review pediatric ethics consultations at a large academic health center over a nine year period, assessing demographics, ethical issues, and consultant intervention. The secondary objective was to describe the evolution of PECs at our institution. This was a retrospective review of Consultation Summary Sheets compiled for PECs at our Academic Health Center between January 2008 and April 2017. There were 165 PECs reviewed during the study period. Most consult requests came from the inpatient setting, (...) with the Pediatric and Neonatal Intensive Care Units being the highest utilizers. Consultation utilization increased over the study period. The most common patient age was less than one year. Physicians were most likely to request consultation. Patient Best Interest, Withholding/Withdrawing of Life Sustaining Therapy, and Provider Moral Distress were ethical issues most commonly identified by the consultants. Making recommendations was the most common consultant intervention. The ethics consultation process evolved over time from informal provider discussions, to a hospital infant care review committee, to a pediatric only consultation service, to a combined adult/pediatric consultation service, with variable levels of salary support for consultants. Ethics consultation requests are growing at our institution. Similarities in identified ethical issues exist between our findings and existing literature, however meaningful comparisons remains elusive secondary to variability in approaches to investigation and reporting. A combined paid/volunteer/trainee ethics consultation service model appears sustainable and real time ethics consultation is feasible using this approach. (shrink)

HARRIS' Hegel's Logic Among the most eminent philosophers of nineteenth-century America were William Torrey Harris (1835-1909) and Charles Sanders Peirce (18391914 ). The former, by his establishment in 1867 of The Journal of Speculative Philosophy, furnished a starting point for American philosophical maturity. The latter, who contributed to that iournal, has been considered America's greatest logician. It may therefore be (...) of interest to examine Peirce's marginalia in the first edition of Harris' chief work, Hegel's Logic: A Book on the Genesis of the Categories of the Mind (Chicago: S. C. Griggs, 1890). Discovered by the present writer on a New York book-stall, in a cheaply priced, coverless, and water-stained copy, and now in his possession, it bears imprinted on the reverse of the title page: "Harvard University: Philos. Dept. Library. Gift of Mrs. Charles S. Peirce. June 28, 1915." Shortly after Peirce, in depressed circumstances, died on April 19, 1914, the Harvard Philosophy Department acquired from his wife the manuscripts that were published in the Collected Papers.1 Harris' Hegel's Logic, which presumably accompanied that transaction, contains several marginal annotations, mostly in faded ink, in a neat, small hand, similar to that reproduced in the frontispiece to Volume IV of Peirce's Collected Papers. Recalling a notable philosophical conjunction, the markings also reveal aspects of Peirce's character and confirm his complex attitude toward Hegel, crucial to the development of his philosophy. Peirce's shifting view and persistent concern regarding Hegel may be traced in some other remarks. For example, in a letter to Harris dated January 1, 1868, he says, "I admit there is music in the logic of Hegel, but that is all I discover there. ''2 In another letter to Harris, dated May 13, 1868, he indicates his ambivalence: "But as I should draw the line... I should come on the same side as Hegel, because I am idealistic. Female coital orgasm may be an adaptation for preferentially retaining the sperm of males with “good genes.” One indicator of good genes may be physical attractiveness. Accordingly, R. Thornhill, S. W. Gangestad, and R. Comer (1995) found that women mated to more attractive men reported an orgasm during a greater proportion of copulations than did women mated to less attractive men. The current research replicates this finding, with several design variations. We collected self-report data from 388 women residing in the (...) United States or in Germany. Results support the hypothesis that women mated to more attractive men are more likely to report an orgasm at the most recent copulation than are women mated to less attractive men, after statistically controlling for several key variables. Discussion addresses (a) the inability of the present research to specify the causal link between female orgasm and male attractiveness and (b) the proactive nature of female sexuality documented in recent research guided by an evolutionary perspective. Outside Waco, Texas, on 19 April 1993, a 51-day standoff between the Federal Bureau of Investigation and David Koresh and the Branch Davidians concluded with a devastating fire. Despite the fact that FBI negotiators talked on the telephone with Koresh or his main spokesman almost every day, the negotiators were unable to bring the standoff to a peaceful end. A frustrating yet persistent aspect for the FBI negotiators was the Davidians' talk about the Bible and their religious beliefs, what (...) agents dismissively described as `Bible babble'. In this study, we analyze several exchanges between Koresh and one of the FBI agents. The analysis shows how the FBI's identifying their problem as `Bible babble' contributed to the negotiation failure. Through their talk, Koresh was positioned as a biblical expert and the FBI agent as a novice. The FBI's talk also supported Koresh's face. These two conversational patterns, we argue, legitimated God as a key party and Koresh as the person who could best speak for him. In the conclusion, we suggest how a renaming of the problem might have reshaped the FBI's moves. (shrink)

The Strategic Studies Institute's XXI Annual Strategy Conference, held at Carlisle Barracks from April 6-8, 2010, addressed the topic of the meaning of war. While it did not seek to produce a definitive answer to questions about the nature and definition of war, it did highlight the crucial questions and their implications, including issues such as whether the cause of war is shifting, whether all forms of organized, politically focused violence constitute war, and the distinction between passive and active (...) war. In the report which follows, Steven Metz and Philip Cuccia of SSI have summarized the presentations and debates at the conference and placed them in their wider intellectual and strategic context. The novel coronavirus disease has become a global pandemic, causing substantial anxiety. One potential factor in the spread of anxiety in response to a pandemic threat is emotion contagion, the finding that emotional experiences can be socially spread through conscious and unconscious pathways. Some individuals are more susceptible to social contagion effects and may be more likely to experience anxiety and other mental health symptoms in response to a pandemic threat. Therefore, we studied the relationship between emotion contagion and mental (...) health symptoms during the COVID-19 pandemic. We administered the Emotion Contagion Scale along with a measure of anxiety in response to COVID-19 and secondary outcome measures of depression, anxiety, stress, and obsessive-compulsive disorder symptoms. These measures were completed by a large student sample in the United States. Data were collected in the months of April and May of 2020 when the fear of COVID-19 was widespread. Results revealed that greater susceptibility to emotion contagion was associated with greater concern about the spread of COVID-19, more depression, anxiety, stress, and OCD symptoms. Consumption of media about COVID-19 also predicted anxiety about COVID-19, though results were not moderated by emotion contagion. However, emotion contagion did moderate the relationship between COVID-19-related media consumption and elevated OCD symptoms. Although limited by a cross-sectional design that precludes causal inferences, the present results highlight the need for study of how illness fears may be transmitted socially during a pandemic.
